The terms for using My account.

This is our English translation for your convenience. The German version prevails.

1. General

These terms of use apply to the use of My account.

The provider of the digital service within the meaning of § 5 DDG (German Digital Services Act) is Alteos GmbH (hereinafter “Alteos”), Managing Director: Dr. Sebastian Sieglerschmidt, Chair of the Advisory Board: Dr. Marc Daniel Zimmermann, Tauentzienstr. 7 b/c, 10789 Berlin. My account is used to provide information and services relating to your insurance contracts electronically. It is set up when the contract is concluded.

These terms of use apply between you as the user and Alteos to the use of My account.

When you take out the insurance contract, you agree to these terms of use by ticking a box. If you do not agree, you cannot use My account.

2. Eligibility, user agreement

Only adult natural persons who have taken out insurance under the Hanna brand through Alteos are entitled to use My account.

Access to My account is password-free. After you enter your email address on the login page, we send you a numeric code by email, valid for a limited time, which you enter in the input field. Once you have entered it successfully, you are logged in to My account.

You are obliged not to distribute any illegal content via My account, not to misuse the functions, to keep your own data up to date and to observe the security precautions.

When using My account, you are obliged not to make any technical interventions, in particular no automated queries, scraping methods or other manipulation of the platform.

We reserve the right to delete illegal content at any time and without giving reasons, insofar as we become aware of it.

3. Services offered

In My account, you can use the following functions online:

  • Changing your contract details and your personal details;
  • Changing your bank details;
  • Viewing your contract documents;
  • Reporting a claim;
  • Cancelling your contract;
  • Changing your cover.

4. Provision of the service

We do not charge any additional costs for using My account.

My account is generally available to you 24 hours a day, seven days a week. However, use may be restricted, for example due to internet disruptions, maintenance work or force majeure.

5. Handling your access data and updating your contact details

To use My account securely, please note the following:

  • As access is via your email inbox, your email account must be protected particularly well against access by third parties. Never pass on the security codes you receive by email to third parties.
  • Always access My account directly through the official website (https://hannadirekt.de) and not through third-party providers.
  • If connection errors occur, close your browser and restart it.
  • Printed or stored data must not be made accessible to unauthorised persons.
  • Do not leave My account open and unattended on your device.
  • If you suspect or know for certain that an unauthorised person has access to My account, please tell us without delay.

Changes to your contact details, in particular your email address, must be updated in My account immediately. We are not liable for damage that arises because notices cannot be delivered due to out-of-date contact details, unless we are responsible for this through intent or gross negligence, or the damage results from injury to life, body and health.

If we have confirmed knowledge or a justified suspicion of misuse of personal access data or of other security-related events in My account, we may take the necessary measures, such as temporarily blocking or permanently closing your access to My account.

6. Functions of My account

We correspond with you mainly in electronic form. For this, documents are placed for you in My account in the “Inbox” area. Whenever this happens, we send you a notification by email to the email address you have given us.

We guarantee that the content of the documents stored in your Inbox will not be changed for as long as they are kept in the Inbox.

You can upload messages and other documents relating to your contracts to My account and send them to us. We process them in the course of normal business operations.

Insofar as you have uploaded your own content (for example documents, messages) to My account, you grant us the non-exclusive right to use this content that is necessary for performing the contract.

You are responsible for keeping the originals of uploaded documents safe and, where necessary, for keeping a copy. Permanent access to the documents while the service is in use is not guaranteed. When the service ends, all documents uploaded to My account are deleted after a reasonable period. Please refer to the provisions in section 13.

7. Liability

For damage caused by misuse of My account, you and we are liable according to the principles of contributory fault in the German Civil Code (§ 254 BGB).

We are liable for damage resulting from an instruction carried out by us that was given after you asked us to block access. However, this does not apply if you acted with fraudulent intent.

There is no liability claim if the circumstances that would give rise to a claim are due to an unusual and unforeseeable event beyond the control of the contracting party relying on it. In addition, it must not have been possible to avoid the consequences of this event even with due care.

Our liability for slightly negligent breaches of duty is excluded insofar as neither essential contractual obligations nor damage from injury to life, body or health are concerned. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.

8. Data protection

My account is used to manage the business relationship and to provide and exchange contract-related information. The processing of personal data that takes place when you use My account complies with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

You can find more information on the type, scope and purpose of data processing and on your rights in our privacy policy (https://hannadirekt.de/datenschutz).

The privacy policy forms part of these terms of use and applies in its current version.

9. Changes to and discontinuation of services

We reserve the right to adapt, extend or discontinue My account or individual functions at any time, insofar as this is necessary to comply with legal requirements or because of technical developments.

We will inform you of significant changes in good time.

10. Copyright and trade mark rights

The trade marks and logos used in My account are protected by law. Use of them without authorisation is prohibited.

11. Changes to the terms of use

We are entitled to change or supplement these terms of use insofar as this is necessary to remedy disruptions to the balance between performance and consideration that arise later, or to adapt to changed legal or technical conditions. This applies in particular to changes in the law, in supreme court case law or in market conditions, and to closing security gaps.

We can make updates and extensions to the range of functions, and adjustments that only serve to improve ease of use, at any time without a notice period and without separate consent, provided that this does not change the main contractual obligations to your disadvantage.

Changes that go beyond the cases named in paragraph 1 (in particular changes to the main obligations) require your express consent.

We will inform you of planned changes under paragraph 1 in text form (for example by email to the address stored in My account) no later than one month before they are due to take effect.

Your consent to changes under paragraph 1 is deemed to have been given if you do not object to the change in text form within the period stated in the notice. In the notice of change, we will separately point out your right to object, the deadline and the legal consequences of your silence.

If you object to the change in time, the contractual relationship continues on the previous terms. In this case, however, we reserve the right to cancel the user agreement with notice in accordance with section 13 if it is not economically or technically reasonable for us to continue on the old terms.

Both parties are entitled to cancel the use of My account without notice for good cause.

When the cancellation takes effect, access is blocked and all stored data is deleted, provided that no statutory retention obligations prevent deletion and the data is not needed to assert or defend against claims.

Personal data is deleted at the latest when the statutory retention periods expire.

14. Final provisions

Disputes arising from the use of My account are governed by the law of the Federal Republic of Germany.

If any provision of these terms is or becomes invalid or unenforceable, or if these terms contain a gap, this shall not affect the validity of the remaining provisions.

The invalid or unenforceable clause shall be replaced, or the gap filled, by an appropriate provision that, within what is legally permissible and economically reasonable, comes closest to what the contracting parties intended or would have intended if they had considered the point.

Otherwise, the statutory provisions apply. Any deviating agreements must be made in text form.

The current version of the terms of use can be accessed at any time in My account and downloaded as a PDF.
